Georgian National Energy and Water Supply Regulatory Commission, as an administrative authority defined by General Administrative Code of Georgia is guiding by the provisions of the Administrative Code (chapter III, Access to Information) when disclosing the public information. Another important guiding document is  Ordinance №7  of the Georgian National Energy and Water Supply Regulatory Commission ‘’On Approving the Standard of Requesting Public Information from Georgian National Energy and Water Supply Regulatory Commission Electronically and the Rule of its Proactive Publication’’, issued on March 28, 2014.

Everyone may request public information irrespective of its physical form or the condition of storage, excluding in the cases foreseen in the law and except for the information that is deemed as a commercial or professional secret or personal data by law. Everyone may choose the form of receipt of public information, if there are various forms of its receipt, and gain access to the original of information.

A public institution shall be obliged to issue public information, including the public information requested electronically, immediately or not later than 10 days, where the circumstances envisaged in the General Administrative Code exist.  If a 10-day period is required for issuing public information, a public institution shall be obliged to notify the applicant of it upon request. Indication of the reason or purpose of requesting the public information in the application shall not be required. When submitting an application to request a commercial secret of another person, an applicant shall present that person’s consent certified by a notary or administrative body, unless otherwise provided for by law.

Public information can also be requested electronically, from the electronic portal of the State Service Agency www.my.gov.ge  or by sending a request with an eligible electronic signature and/or eligible electronic stamp to the email of the person responsible for the availability of public information at the Commission.

In case of a natural person sending the electronic request for disclosure of public information electronically, the email shall contain the following information:

  • Name and surname of the applicant
  • Personal identification number
  • Contact telephone number 

In case of a legal entity:

  • The name of the organization
  • Taxpayer’s number
  • Legal address, contact telephone number, name and surname of the director

Person requesting information in the material form or saved on the electronic memory device (optical disc or USB memory stick), shall pay the fee defined in the Georgian Law on Fee for Making a Copy of the Public Information, unless the person presents the electronic memory device to the Commission or if the material form of the requested information is more than 10 pages.

Public institution must immediately notify an applicant of the refusal to issue public information.
